DELAYED BIRTHS

 

  

 

 

WHO MAY FILE:                                                      

Any person born in North Carolina who is more than one (1) year of age and for whom no certificate is already on file. For children under one (1) year of age, a regular birth certificate must be filed with the registrar at the local health department.

FACTS TO BE PROVEN:

1.  Full name at time of birth

2.  Date of birth

3.  Place of birth

4.  Mother’s full maiden name

5.  Father’s full name (omit name of father if born out of wedlock) 

Note: You will need to visit our office and complete a Delayed Birth Certificate form that we will forward to Vital Records in Raleigh on your behalf. You must furnish a minimum of three records from independent sources which need to be notarized or certified by the proper authority which shows the facts to be proven. Due to changing criteria and complexity of certain records, we suggest you call our office before bringing in proofs that may be insufficient. 

REQUIREMENTS

1.  You must submit at least THREE RECORDS from independent sources which show the facts to be proven.

A. Two of the three records must be notarized or certified copies of official records from independent sources and must have been established for at least five years for applicants five years old or older. It is strongly preferred that one of these two records be an elementary school record signed by the custodian of records for that school system or that a “no record found” letter from the Superintendent of Schools in that jurisdiction be provided to document that such records were solicited. If no school records are provided these two records should be other proofs of identity established and used early in life – the earlier the records, the better. A “no record found” letter is not a proof document but evidence that an attempt was made to locate such.

     B. One of the three records may be an affidavit of personal knowledge by someone older than the applicant who has personal knowledge of the facts.

2.   All three records must prove name and date of birth or age and agree as to those facts in question.  Two of the three records must show birthplace. One of the three records must show full name of father (if born in wedlock) and full maiden name of the mother.

RECORDS NORMALLY ACCEPTED AS PROOFS:

 

These records are listed in the order of preference and must have been established for 5 years for those applicants 5 years and older.)

  1. Elementary School Record (most preferred record - see information in above section)

  2. Hospital birth record

  3. Attendant's (doctor or midwife) record

  4. Immunization record certified by physician or health dept.

  5. DD214 (Selective Service Record)

  6. Marriage license of applicant

  7. Birth certificate of child of applicant

  8. Census Record

  9. Numident report from Social Security Administration

  10. Affidavit of personal knowledge

Other possible records of proof include passport, insurance applications or policies, employment records, social services records; court records; voting registration records; hospital admission records; professional examination applications; tax records; and driver’s license.

WHERE TO FILE:

After obtaining the proofs, bring them to the REGISTER OF DEEDS IN THE COUNTY WHERE THE BIRTH OCCURRED  for review and processing. Vital Records will not process the delayed birth certificate application until it has been processed in the county office.
